Refugees are the primary target of the Court’s decision in DHS v. Thuraissigiam, but the the opinion endangers everyone – U.S. citizens included – by reopening settled questions about the Habeas Corpus Suspension Clause of the Constitution. Justice Alito not only rewrote and marginalized prior precedent on habeas corpus, but reached out to decide a procedural due process issue that his own analysis had rendered irrelevant.
