In 1761, British troops were going home to home with only a general warrant, acting on a generalized belief that someone was doing something wrong.



For the first time, American colonists stood up to defend a fundamental freedom: the right to be secure from unreasonable searches and seizures. A fiery advocate, James Otis Jr, led the case. Watching from the courtroom was a 25-year-old training to become a lawyer, John Adams. Years later, though they had lost the case, Adams wrote that "the child Independence was born." Which led to James Madison proposing the Fourth Amendment and its protection of the right to privacy.
